LAWYERS ASK COURT TO SANCTION MAYWEATHER, RENDER DEFAULT JUDGMENT IN PACQUIAO'S FAVOR By Ronnie Nathanielsz PhilBoxing.com Sat, 06 Aug 2011 Pound-for-pound king Manny Pacquiao's lawyers have filed a motion with the District Court of Nevada seeking sanctions against Floyd Mayweather Jr for his refusal to appear for deposition and to answer questions under oath over his allegations that Pacquiao was on performance enhancing drugs that accounted for his success in the ring and to render default judgment in favor of Pacquiao. Atty. David Marroso told the Daily Inquirer that in their motion for "default and dismissal" against Mayweather Jr before Judge Larry Hicks they charged Mayweather with "deliberately defying a court order to appear at deposition on any of the 24 alternate dates offered by Pacquiao." Marroso contradicted Mayweather's claims that he could not provide his deposition because he was in training and avoiding all distractions and provided supporting evidence including photographs. Marroso accused Mayweather of "lying repeatedly to avoid appearing for deposition." He said Mayweather "refused to participate in Court-ordered discovery because it interfered with his partying schedule." The lawyer noted that on July 1, a date Pacquiao offered to have Mayweather's deposition taken he hosted a party at a nighgtclub in Atlanta. Marroso claimed that on dates he professed to be so focused on fight preperations that he could not comply with a Court order Mayweather "actually danced, partied and handed out bottles of champagne to partygoers" while on July 2 he "encouraged fans to join him at Club Eve in Aria Hotel in Las Vegas. Marroso alleged that on July 3, Mayweather "attended an adults only Midnite Theme Park at Circus Circus in Las Vegas to celebrate rapper 50 Cent's birthday." Stating that Pacquiao was "misled about Mayweather's true whereabouts and Commitments" and had offered to take the deposition any day the week of July 12, Mayweather refused, claiming to be unavailable and accusing Pacquiao of "gamesmanship" and intentional "interference" with his fight preparations for a September 17 showdown with Victor Ortiz. Mayweather boasted that he is "the only elite boxer in the world to have a 41-0 record" and that he "has this record because of his commitment to the fight training and because he avoids the distraction of anything except preparation for and focus upon the fight." Marroso stated that Mayweather's representations were "demonstrably false" noting that when he claimed that on July 6 he was "already in training camp and intensely preparing for his upcoming fight" Mayweather "traveled to Atlanta to host a pair of parties on July 9 and 10 at which cameras captured Mayweather dancing, partying and burning what appears to be US currency."
