ATTY. SALUD SAYS PACQUIAO SHOULD HONOR GOLDEN BOY CONTRACT By Ronnie Nathanielsz PhilBoxing.com Tue, 21 Nov 2006 WBC founding secretary general and eminent lawyer Rudy Salud yesterday cautioned Filipino ring idol Manny Pacquiao to honor the contract he signed with Golden Boy some two months ago because there could be ?big legal trouble? if Pacquiao considers himself a fighter of Top Rank promoter Bob Arum. Salud made the statement after Arum announced that Top Rank and Manny Pacquiao Promotions had signed a contract to promote Pacquiao?s fights for the next four years. The announcement was made some two months after Pacquiao signed a seven-fight deal with Golden Boy Promotions following a dinner meeting with Oscar De La Hoya, the night Pacquiao arrived in Los Angeles to begin preparations for the Morales rubber match. However, Arum told Viva Sports/Manila Standard Today some one month ago that he was confident Pacquiao would be fighting for Top Rank after November 18 although he declined to reveal specific details to support his claim. At the post-fight press conference Saturday, Arum claimed that ?Manny was under contract not to sign with any other promoter? and that his lawyers advised him ?after he signed with Golden Boy.? Arum said Pacquiao had since renounced the Golden Boy signing and given back the money.? However, Golden Boy refused to accept the check and all indications point to a legal battle between bitter rivals De La Hoya and Arum. Salud emphasized that Pacquiao ?cannot sign a contract and afterwards return the money and sign with somebody else as if nothing happened because he returned the money.? He said it was ?not allowed by law? since it would create chaos. Salud cited the example of selling a property for $500,000 and when someone else a few days later offers $1 million you return the money and get back the property. Salud surmised that Arum who is a lawyer is likely to insist that the Golden Boy contract was not an ?executed contract? and that it was ?not executed by any fight or any agreement for a fight executed by Golden Boy Promotions and therefore Pacquiao could rescind it as of this moment.? Salud said ?that is not true.? He said ?once there is a meeting of the minds which is signified by signing a contract with terms and conditions and the two parties affix their signature and Manny received an advance, that?s executed.? Salud said that even without the money which was reportedly $500,000 , by signing the contract there was a meeting of the minds. In reference to Arum?s stipulation that Pacquiao was prohibited from signing with any other promoter under the Morales Grand Finale fight contract with him, Salud said the stipulation is in relation to ?any fight before the Morales fight and not any fight after.? Salud indicated that there could be no breach of contract or tortuous interference because there could be no such thing for a ?future unspecified fight with an unnamed opponent.? Salud suggested that Pacquiao?s advisers advise Pacquiao ?not to mind Arum.? Saying he believes Pacquiao signed the Arum contract after the Golden Boy deal but before the Morales fight, Salud said Pacquiao can claim he signed under duress because Arum could have cancelled the fight if he didn?t sign with Top Rank. ?That is a non-contract?
