Open letter to Donaire, Jr.: You deserve a legal spanking from a fellow Boholano

I really do not want to come this far. But, let me tell you, three of my friends who are licensed criminal lawyers have advised me to file a lawsuit against you, my fellow Boholano, Nonito Donaire, Jr. I say “fellow Boholano” because my great grandfather hailed from Anda, Bohol just five towns southeast of Talibon where you were born. At this time, I know you can afford to pay a lawyer to answer my criminal and civil case under the teeth of the Federal law. But, the money you make from the Montiel fight may not be enough to cover the blunt result of your irresponsible utterances.The issue spins from your recent statement on your own Facebook account. I have verified that account. And your IP address confirms it. The head office of Facebook in Palo Alto, California has it all. This time, don’t tell me that you do not own the account nor must you say that such statement was made by your public relations team, that which you are still held responsible and accountable. I would not give you an avenue to make an excuse this time, nor should I give you a chance to make an outright lie denying of such making.

Here’s your statement: “Chino, Pinol, n Ampong. Shut up n Leave my family alone: the Donaires n Marcials, esp my wife. Keep talking n ull feel what Montiel felt. U won’t see it, ull just feel it. Sonic Boom!!”

Being a registered law student by the State Bar of California for Juris Doctorate Program, I have to make sure that I am in the right position before I confer this same issue with my colleagues and superiors in the field of law. But, I rather share with you the consequences of your threat. You must know the California has specific provisions within its penal and civil codes to address the issue of verbal threats. While you are occupying a murky region between everyday speech and physical harm, verbal threats are nevertheless punishable by both criminal and civil penalties. And I want to make sure you understand this issue. And I will not back off unless you issue a public apology. If it so happens that you would make excuses and rationalize that it’s not of your own making, then so be it. Enough items as evidence have been gathered, including your IP address, to warrant that such was your own making, plus the trend of all your statements on such Facebook account.

Your threat is so deliberate. It connects with all the video productions your team has produced. Just like what journalist and former North Cotabato Governor Manny Pinol said, I tell you: Do not threaten me or other media people with your Sonic-Boom punch that knocked out Fernando Montiel. The teeth of the Federal law is so vicious than your “sonic-boom” threat could get your bankrupt this time. “Verbal threats in California are covered under sections 422, 649.9 and 653m of the Penal Code. The first section deals with “Criminal Threats”, and it specifically outlines what constitutes such threats.” the California State Law on Verbal or Internet Threats states. “Essentially, the subject is to anyone who threatens to kill someone or cause great bodily harm to a person. What is important is not so much whether the person making the threat actually intends to carry it out, but rather whether the threat is intended to instill fear in the victim.”

I must tell you this: There is the tort of stalking under section 1708.7 the California Civil Code. “This allows an individual to sue another person for the all of the actions described above, entitling them to monetary damages for pain suffered. Because civil cases do not have to be proved beyond a reasonable doubt, it is much easier to get a judgment against someone making verbal threats.”

Therefore, you would not only think to consider the penalties in terms of jail time, but also in terms of your bank accounts.

Don’t make a mistake, I would love to see you fighting, not for your jail time, but for a real fight in the ring against great champions. I tell you Nonito, Jr.: You can afford anyway. You said you made over $160,000 from your last fight. But, you need a bigger fight to afford your threats, anyway.

Let me remind you this: I touched on that same issue primarily about the “falling out” of the father-and-son tandem and all other related issues simply because I felt the intensity of the old man’s agony – Nonito Donaire, Sr, your father. I am a father of two boys, and a husband of a hardworking Filipina. And my intent was to make you be aware that, despite economic success in this land of milk and honey, respecting our parents is still relevant in today’s world. I suppose my articles about the same issue, as published, are well-balanced. I even have pressed on the aspect of stimulating you to think of celestial matters rather than temporal ones. I even see you as a potential source of pride of the Maharlikan nation. In that, you can be a catalyst in enriching our heritage – for better family values, that which a better moral rectitude can be embraced from one generation to another. In fact, I have cited that I am hopeful a “genuine reconciliation” will soon come to pass. But, you have become so big in your head. You think that can control manipulate the media with your lies and threats.

Nonetheless, I would not discuss further. I rather demand that you send your letter of apology within 24 hours from this time of publication. Your PR man, Dennis Guillermo, should get this message straight to you. He follows every article I have published.
